If you are a resident of a state with specific privacy rights (for example California, Virginia or Nevada), that state law may provide you with additional rights. Shopify (platform & hosting), payment processors (Shopify Payments, Stripe, PayPal), shipping carriers (USPS, UPS, FedEx), analytics & email/SMS providers, fraud detection vendors, and other vendors who perform services on our behalf. Shopify and these providers act as processors and follow industry practices to protect data.  

4.2. Business transfers  
In the event of a merger, acquisition, or sale of all or substantially all assets, personal 
information may be transferred as part of the transaction. 
4.3. Legal  
When required by law, regulation, litigation or government request we may disclose personal information. We do not sell personal information for monetary consideration. Where a state law defines “sale” broadly and you have a right to opt out, our practices and opt-out mechanisms are described in the “Your Rights” section below.

We retain personal information only as long as necessary to operate our Shopify-powered store, fulfill skincare product orders, provide customer support, comply with applicable laws, and protect our legitimate business interests such as fraud prevention and dispute resolution. Once retention periods expire, information is securely deleted, anonymized, or archived in line with our data management practices. 
6.1. Account Data 
If you create an account with us, we will retain your account information for as long as your 
account remains active. Following account deletion, certain details (such as order history or 
consent records) may be retained for up to three (3) years to comply with legal obligations, 
prevent fraud, resolve disputes, and enforce agreements. 
6.2. Order and Product Information 
Information related to purchases, including order details, invoices, shipping records, and returns, is retained for as long as necessary to complete your transaction and provide customer service. After fulfillment, we may keep records for tax, warranty, recall, and compliance purposes. 
6.3. Financial and Transactional Records 
Financial records, such as payment confirmations, invoices, refunds, and chargeback 
documentation, are retained for a minimum of seven (7) years to comply with tax regulations, accounting standards, and anti-money laundering (AML) laws. 
6.4. Communication Records 
Customer service messages, emails, chat logs, reviews, feedback, and consent records may be retained for up to five (5) years to ensure service quality, verify user requests, and comply with privacy law requirements (e.g., GDPR, CCPA, Virginia CDPA).

However, no internet transmission or storage system is 100% secure. Although we are based in the U.S., some third-party processors (e.g., analytics/email providers) may store or process personal information in other countries. When transfers occur, we rely on appropriate safeguards and vendor contractual provisions to protect data.

Our website is not intended for children under 16. We do not knowingly collect personal information from children under 16. If we learn we have collected such information, we will delete it. Parents or guardians who believe their child provided us information may contact support@almarinbeauty.com.

Under the California Privacy Rights Act (CPRA), certain additional obligations apply to businesses that meet statutory thresholds. 10.2. Virginia (VCDPA) 
Virginia residents may have rights to:

IV. Obtain a copy of personal data in a portable format. 
V. Opt out of targeted advertising and the sale/processing of data for certain profiling. 
The Virginia Consumer Data Protection Act (VCDPA) applies to businesses that meet specific thresholds. We will honor verified requests from Virginia residents. 10.3 Nevada (SB220) 
Nevada residents have the right to opt out of the sale of certain personal information. To submit a request, Nevada residents may contact us at support@almarinbeauty.com with “Nevada Opt-Out” in the subject line, including sufficient details to verify identity and residency. We maintain a designated contact for Nevada privacy requests and will honor valid submissions under Nevada SB220.

II. We will verify identity using reasonable methods, such as order number, account information, or email verification. 
III. Requests made by an authorized agent must include a signed authorization, and we may verify directly with the consumer.

comply with legal obligations, or prevent fraud. In such cases, we will notify you of the denial and the legal basis.

11. OPT-OUT AND DO-NOT-SELL  
We do not intentionally sell personal information for money. Where a law defines “sale” more broadly (e.g., certain advertising practices), we provide opt-out controls for targeted advertising and any practice that could be defined as a sale or sharing. 16.1. Shopify Processors  
We use Shopify as our e-commerce platform, Shopify acts as a processor and stores order and transactional data. Payment card processing is handled through Shopify Payments, Stripe or other processors; we never store full card numbers on our servers. Shipping carriers receive name/address and necessary order details for delivery.  
16.2. Consent and CMP  
We use a cookie banner and preference center to obtain initial consent for non-essential cookies and to store those preferences so we load only permitted cookies. 
16.3. Data Minimization & Purpose Limitation  
We collect only the personal information necessary for the purposes described (order fulfillment, customer support, legal compliance, marketing where you consent).
